A provision buried in the House Republican reconciliation package would ban states from taking any regulatory or legislative action on artificial intelligence (AI) for ten years. AASA opposes this federal overreach, and joined more than 140 organizations in a letter opposing the inclusion of the provision in the broader reconciliation package. Federal preemption is a legal doctrine in the US that clarifies when federal law supersedes state laws. Given the ever-evolving nature of AI, and the rapid rate with which it is integrating all aspects of life, there is concern that a blanket ban on state policy to help shape and craft meaningful guardrails for use, integration, and adoption of AI is short sighted and overwhelmingly problematic.
